These Terms of Service ("Terms") govern your access to and use of PixelPicker.io ("the Service"), operated by Elbado Digital Products ("we," "us," or "our"). Please read these Terms carefully before using the Service.

By accessing or using PixelPicker.io, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of Service

PixelPicker.io is a free, browser-based tool that allows users to:

  • Upload images from their device to extract colors
  • Pick specific pixel colors and copy HEX/RGB codes
  • Generate dominant color palettes from images
  • Download color palette cards as PNG images

The Service operates entirely within your web browser. No images are transmitted to or stored on our servers.

2. Eligibility

By using the Service, you represent that:

  • You are at least 13 years of age (or the minimum age in your jurisdiction).
  • You have the legal capacity to agree to these Terms.
  • Your use of the Service complies with all applicable laws and regulations.

3. Acceptable Use

You agree to use PixelPicker.io only for lawful purposes. You must NOT:

  • Use the Service to process images you do not have the right to use.
  • Attempt to reverse engineer, modify, or create derivative works of the Service.
  • Use automated tools to scrape or overload the Service.
  • Remove or obscure any copyright, trademark, or proprietary notices.
  • Use the Service in any way that violates applicable laws or regulations.
  • Attempt to gain unauthorized access to any portion of the Service.

4. Intellectual Property

4.1 Our IP

The PixelPicker.io name, logo, design, code, and content (excluding user-uploaded images) are the intellectual property of Elbado Digital Products and are protected by applicable copyright, trademark, and other laws.

4.2 Your Images

You retain all rights to images you upload to PixelPicker.io. By using the Service, you confirm that you own or have the necessary rights and permissions to use any images you process through the tool.

Since PixelPicker.io is fully client-side, your images are never transmitted to us and we make no claim over them.

4.3 Extracted Colors

Colors (hex codes, RGB values) and palette cards generated by the Service are yours to use freely in your personal and commercial projects.

5. Third-Party Services and Advertisements

PixelPicker.io uses third-party services including:

  • Google Analytics — for website usage analytics
  • Google AdSense — for displaying advertisements

These services are governed by their own Terms of Service and Privacy Policies. We are not responsible for the content of advertisements displayed by Google AdSense. If you see an inappropriate ad, you may report it directly to Google.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Accuracy, reliability, or completeness of the Service
  • Uninterrupted or error-free operation
  • Freedom from viruses or other harmful components

We do not warrant that the color values extracted by the Service will be 100% accurate for all use cases, including professional printing.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ELBADO DIGITAL PRODUCTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any content obtained from the Service
  • Unauthorized access to or alteration of your data

Our total liability to you for any claims arising from use of the Service shall not exceed $10 USD.

8. Links to Other Websites

Our Service may contain links to third-party websites such as elbado.com and pixelqr.io. We have no control over the content or practices of these websites and accept no responsibility for them.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

11. Changes to Terms

We may update these Terms from time to time. We will indicate the date of the most recent update at the top of this page. Your continued use of the Service after changes constitute your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes shall be resolved through good-faith negotiation or, if necessary, binding arbitration.
